Vivendi seeks Polish partner for TVN bid: sources (Reuters)

WARSAW (Reuters) ? French entertainment and media group Vivendi could team up with a local Polish partner to squeeze synergies out of its possible buy of broadcaster TVN, sources close to the situation said.

One of the sources, who declined to be named, said Vivendi was considering allying itself with a telecoms sector company. The person added that several scenarios were being assessed but that the deal was complex, given the current market turmoil and fraught economic outlook.

A report in Polish daily Rzeczpospolita said Vivendi, citing an unnamed source, could turn to Poland's largest telecom operator TPSA after acquiring TVN to create a media and telecoms partnership with possible capital ties.

TPSA, a unit of France Telecom, and TVN declined to comment.

TVN's parent company ITI Group in July began a process to sell its 56 percent stake in TVN Group, which some analysts have valued at $1.3 billion. TVN operates a pay-TV business, free-to-air channels, and Poland's biggest web portal.

In France, Vivendi owns the largest pay-TV business Canal+, which specializes in high-end exclusive content including movies and football matches. It is also in the telecoms business via its SFR mobile operator.

In Poland, the French group controls the country's No. 2 pay-TV platform Cyfra+, which could be merged with TVN's rival 'n' platform.

Vivendi faces competition in the bidding for TVN, with Polish media reports saying U.S. rival Time Warner and Bertelsmann-owned RTL Group are still in the running.

On Monday, the head of Vivendi's supervisory board was quoted in the Polish media as saying the company was interested in buying the controlling stake in TVN, put up for sale by its owner ITI, with a local partner.

JP Morgan and Nomura are advising ITI on the sale.

Insurance whistle-blower Potter speaks in support of Obama health ...

HALLOWELL, Maine ? The Obama administration?s heath care overhaul isn?t making everyone happy, but health insurance industry whistle-blower Wendell Potter says it?s an important step in the right direction.

Potter told a coalition of liberal-leaning advocacy groups and policy organizations on Wednesday that supporters of the Affordable Care Act must be well informed and speak with one voice in defending it against powerful groups that seek to overturn it or undo the key consumer protections it contains.

The ACA ?is far from perfect but it is a strong start and already making improvements in the lives of Americans,? Potter said, speaking to the first formal meeting of a group known as the Health Care for Maine Alliance. The group met at the Maple Hill Farm conference center in Hallowell.

For example, Potter said insurance companies can no longer refuse to cover children with pre-existing medical conditions, small businesses get new tax breaks for offering coverage to their workers, young adults can stay on their parents? policies until they turn 26, and the infamous ?donut hole? coverage gap in the Medicare Part D prescription gap is closing.

In 2014, health insurance market places known as ?exchanges? will help consumers choose affordable coverage that works for them, just in time to comply with the ACA?s ?individual mandate? that requires most Americans to have health coverage or pay a penalty.

In 2007, Potter walked away from a lucrative public communications career with Cigna insurance company after having what he terms ?an epiphany? about the industry?s profit-making priorities. Since then, Potter has been in demand as a speaker and has written a book about the insurance industry titled ?Deadly Spin.?

Companies such as Cigna are ?enormously rich monopolies? that ?comprise a cartel that has assumed the power to decide who lives and who dies,? Potter said on Wednesday. By constantly raising the cost of insurance and developing new reasons to deny coverage, Potter said insurance companies are engaged in a systematic effort to ?get the old and the sick off their books.?

Insurance companies, he said, support the ACA because the individual mandate guarantees them millions of new customers. In part because of the industry?s support, Potter expects the ACA to be upheld by the ?very political? U.S. Supreme Court, despite challenges from conservative Republicans and business groups that have questioned its constitutionality.

But he cautioned that the powerful, organized and well-funded insurance lobby is hard at work trying to erode certain ACA consumer protections, such as one provision that requires insurers to spend 80 cents of every premium dollar on actual health care services, and another that subjects proposed rate increases to approval by state insurance superintendents.

Americans who want to ensure the overhaul gets implemented as enacted must ?have a well thought out strategy and work as a well coordinated team, or we?re going to get slaughtered by these guys,? Potter said during his lunchtime address.

Potter said the American health care system is in a crisis and headed toward collapse if major changes are not adopted.

In a conversation before his lunchtime talk, Potter said he has been speaking to church groups about the Affordable Care Act and the need to overhaul the nation?s health care system.

?I believe people of faith have been misled in devious ways ? in an effort to get them to vote against their own interests,? he said.

Potter said the administration of Gov. Paul LePage and the new Republican majority in Augusta were heavily influenced by insurance lobbyists in their support for LD 1333, a contentious bill passed during the last legislative session that significantly lightened the regulation of health insurers in Maine.

?I have no doubt [the lobbyists] were doing high-fives when LePage was elected and the Legislature flipped,? he said. ?I can?t imagine there was anything they wanted that they didn?t get? in the new law.

Potter?s visit to Maine was funded by the Health Care for Maine Alliance, whose steering committee includes representation by the American Cancer Society, AARP, the Maine Center for Economic Policy, the Maine Medical Association, Consumers for Affordable Health Care and other groups.

UK firm buys control of Libyan oil field company (AP)

LONDON ? British company Heritage Oil PLC said Tuesday that it has acquired a controlling interest in a Libyan company licensed to provide oil field services including offshore and land-based drilling.

Heritage said it paid $19.5 million for a 51 percent stake in Sahara Oil Services Holdings Ltd. Heritage said the acquisition will allow it to play a significant role in Libya's oil and gas industry.

Sahara Oil Services was established in 2009 and is based in Benghazi.

Heritage established a base in Benghazi this year and has been dealing with senior members of the National Transitional Council, the company said.

Richard Griffith, analyst at Evolution Securities, said the move "could prove to be a very shrewd investment" by the company.

Heritage Oil shares, however, were down 2.9 percent at 217.8 pence in early trading on the London Stock Exchange.

The company's CEO Tony Buckingham said they are "well placed to play a significant role in the future oil and gas industry in Libya."

"This acquisition is consistent with Heritage's first mover strategy of entering regions with vast hydrocarbon wealth where we have a strategic advantage," Buckingham said.

Heritage has exploration projects in the Kurdistan Region of Iraq, the Democratic Republic of Congo, Malta, Pakistan, Tanzania and Mali, and a producing property in Russia.

How the major stock indexes fared on Monday (AP)

The latest setback in Greece's financial crisis sent the Standard and Poor's 500 index to its lowest level of the year, putting it on the edge of a new bear market.

European markets slumped, dragging U.S. stocks down along with them, after Greece said it will miss deficit reduction targets it agreed to as part of its bailout deal. The renewed concerns about Europe's debt problems pushed the euro down to $1.32 versus the dollar, a 9-month low.

The Dow Jones industrial average fell 258.08 points, or 2.4 percent, to 10,655.30.

The S&P 500 lost 32.19 points, or 2.9 percent, to 1,099.23.

The Nasdaq composite slid 79.57 points, or 3.3 percent, to 2,335.83.

For the year to date:

The Dow is down 922.21, or 8 percent.

The S&P 500 is down 158.41, or 12.6 percent.

The Nasdaq is down 317.04, or 12 percent.

Why Many of the Health Care Reforms will Not Go Into Effect Until

Before starting my article I will like to say a few words about health.

?Every human being is the author of his own health or disease.?
?He, who has health, has hope. And he, who has hope, has everything.?
?It is health that is real wealth and not pieces of gold and silver.?

President Obama signed the health care reform bill into effect March 23, 2010. But why is it that some of the changes in the bill will not take effect until 2014? For example, the popular regulatory change that will prohibit insurance companies from denying coverage to a those with pre-existing medical conditions will not go into effect until 2014. (But the regulation that prevent insurance companies from denying coverage to children with pre-existing conditions will go into effect this year.)

The reason is because the health care system is a complex interconnected system where one piece cannot be implemented without another piece. The health care reform bill calls for the creation of health care exchange pools. And it is the creation of these exchange pools (of which none exists right now) that would take four years to implement.

SFGate.com says ?We understand why there?s a long wait for these reforms ? it?s going to take a great deal of time to set up all the necessary administration for insurance exchanges and subsidies.[1]
Why the need for health-care exchanges?

Prior to the passage of the health-care reform bill, individuals and small businesses who wants to buy insurance on their own will have to pay many times more than what a large corporate employers has to pay for the same individual as an employee (assuming equivalent coverage).[2] That is because if the insurance company can sign up for coverage for a group of people that contains a wide range of health statuses with both healthy and not so healthy, then they can reduce their risk against incurring a huge payout that exceeds their premium revenue. Insurance companies do not like to sign up a single individuals and will raise the price for that individual. Health-care exchanges are designed to group all these individuals and thereby they act as a group. This hopes to reduce premiums making it affordable for small or single individual businesses to pay for their own insurance.

Another change that goes into effect in 2014 is the individual mandate that everyone buys insurance. We cannot implement this mandate until these exchanges are in place to make the premiums affordable.

And until we have a individual mandate in place, we cannot add regulations that would eliminate the insurance company practice of denying coverage to people with pre-existing conditions. Because if we add that regulation without the individual mandate, the price of premium will skyrocket. (However, the lawmakers felt that children were important to warrant that the regulation go into effect earlier for children of pre-existing conditions.)
